Official Rules

NO PURCHASE OR DONATION NECESSARY. A PURCHASE OR DONATION WILL NOT INCREASE YOUR CHANCES OF WINNING. SWEEPSTAKES IS OPEN ONLY TO LEGAL RESIDENTS OF THE 48 CONTIGUOUS UNITED STATES AND THE DISTRICT OF COLUMBIA, WHO ARE 18 YEARS OF AGE OR OLDER AT TIME OF ENTRY. VOID IN ALASKA, HAWAII, PUERTO RICO AND WHEREVER ELSE PROHIBITED BY LAW.

SWEEPSTAKES PERIOD: The Ecodrive E-Bike Sweepstakes (the “Sweepstakes”) begins at 12:00 a.m. Eastern Time (“ET”) on July 7, 2021 and ends at 11:59:59 p.m. ET on August 31, 2021 (the “Sweepstakes Period”). The computer of Ecodrive LLC (“Sponsor”) is the official timekeeper for this Sweepstakes. By participating in this Sweepstakes, entrants agree to be bound by these Official Rules and the decisions of the Sponsor, which are final and binding.

ELIGIBILITY: Open only to legal residents of the 48 contiguous United States and the District of Columbia who are 18 years of age or older at time of entry. Void in Alaska, Hawaii, Puerto Rico and wherever else prohibited or restricted by law. Employees of Sponsor, Revival Cycles, their respective board members, divisions, printers, website developers, vendors, suppliers, affiliates, advertising agencies, Marden-Kane, Inc. (the “Administrator”) and anyone else affiliated with the Sweepstakes or the execution of the Prize Drawing (collectively the “Releasees”) and members of their immediate family (children, parents, siblings, grandparent and spouse) and individuals living in their household whether related or not, are not eligible to participate. All federal, state and local laws and regulations apply. Winning a prize is contingent upon fulfilling all requirements set forth herein.

HOW TO ENTER: There are two (2) ways to enter, as detailed below:

1) Online Donation: Eligible individuals who make an online donation on Sponsor’s website at https://ecodrive.community will receive one (1) automatic Sweepstakes entry for every $1.00 donated which means one (1) tree will be planted by Sponsor on the Island nation of Madagascar. No limit on number of entries received with a donation on https://ecodrive.community. Your donation must be received by 11:59:59 p.m. ET on August 31, 2021 in order to be eligible to receive Sweepstakes entries. If a donation is not accepted prior to the drawing, entries associated with that donation will be voided. All donations are subject to Sponsor’s policy.

2) Mail-In Method of Entry: To enter without donating, hand-write the following on the front of a 3” x 5” piece of paper, which must be made of either recycled paper or tree-free paper: your name, address, city, state, ZIP code (no PO Boxes allowed), e-mail address, telephone number and date of birth, then on the back of the paper, in at least 20 words, hand write a response to each of the Following four (4) questions:

Did you know that Ecodrive plants trees to help offset carbon emissions, and has a program where you can plant trees on a monthly basis to offset your footprint. Is this something you would be interested in taking part in?
Will you look to offset your carbon footprint with Ecodrive in the future to help protect our planet through tree planting on their website www.ecodrive.community?
Do you believe in climate change?
Are you willing to plant trees with Ecodrive to help do your part in the fight against climate change?

Each entry must answer all four questions to be eligible. Answers submitted will not be judged; however they must not in any way reflect negatively upon Sponsor, the Sweepstakes or any other person or entity. Insert your mail-in entry in a #10 size envelope that also must be made of either recycled paper or tree-free paper and must be clearly marked as such on the outside of the envelope, that must have your full name and complete valid mailing address, located in the 48 contiguous United States or the District of Columbia to confirm status as a current legal resident, that is legibly hand written in the upper left hand corner on the outside of the envelope with only an affixed first-class postage stamp that can be used to pay for full postage delivery fee (using a metered postage machine will not be accepted as a form of payment for postage and will result in disqualification), then mail to: The Ecodrive E-Bike Sweepstakes, 822 Brickyard Lane, Costa Mesa, CA 92627. Each envelope must be mailed individually; bulk shipments (multiple entries in one shipping package) will not be accepted and will be destroyed. All mail-in entries (limit one per outer mailing envelope) must include all requested information (as stated above) and must be postmarked by August 31, 2021 and received by September 7, 2021 to be considered a valid entry. Entrants can earn five (5) Sweepstakes entries per each eligible mail-in entry. No limit on number of entries received via the no-donation method of entry (mail-in entries). Requests for confirmation of receipt of mail-in entries will not be acknowledged. No photocopies, facsimiles or reproductions of mail-in entry will be accepted. Sponsor is not responsible for late, lost, damaged, stolen, incomplete, incorrect, illegible, postage due, or misdirected entries. Proof of mailing does not constitute proof of delivery. All information must be complete to be eligible. Personal information collected from entrants is subject to Sponsor’s privacy policy https://ecodrive.community/policies/privacy-policy and will be used only for the purpose of the Sweepstakes and will not be re-used, sold or shared in any manner; unless entrant agrees to receive further information on Sponsor’s or prize partner’s products and promotions. Entrants are not required to opt-in to receive further communications from the Sponsor in order to participate in this Sweepstakes and opting in will not increase your chances of winning. Use of computer programs and/or other automated devices to enter Sweepstakes is prohibited and those entries will be disqualified.

ENTRY MULTIPLIER: Throughout the Sweepstakes Period, the Sponsor may announce opportunities to increase the number of entries you may earn by a multiplier (e.g., (2X), (3X), (4X), (5X) or (10X) (each an “Entry Multiplier”). During an Entry Multiplier offer, entries will be multiplied by the applicable Entry Multiplier. For example, a donation of $25 during a 2X Entry Multiplier offer will earn 50 entries. Timing for an Entry Multiplier offer will be determined solely by the Sponsor and will be announced at https://ecodrive.community. To receive additional entries during an Entry Multiplier offer without making a donation, follow the instructions for mail-in entries above, and hand write the words “ENTRY MULTIPLIER” in the bottom left-hand corner of the envelope. Your mail-in entry must have a postmark that corresponds to the dates of the donation announcement and received within 5 days of the offer’s deadline. If an Entry Multiplier donation announcement falls on a Sunday or holiday, the mail-in entry must be postmarked on the following business day and received within 5 days.

BONUS ENTRIES: During the Sweepstakes Period, the Sponsor may announce opportunities to earn bonus entries (a “Bonus Entry Period”). During a Bonus Entry Period, donations at https://ecodrive.community will earn an additional: ∙ 15 bonus entries with a $30-$49.00 donation ∙ 25 bonus entries with a $50-$99.00 donation; or ∙ 50 bonus entries for every donation of $100 or more. To earn 5 Bonus entries without donation, follow the instructions above for your mail-in entry and hand-write the words “BONUS ENTRY” on the lower right-hand corner of your outer-mailing envelope. Your mail-in entry must have a postmark date that corresponds to a Bonus Entry Period and be received within 5 days of the Bonus Entry Period’s deadline. There is a limit of 500 Bonus entries per person/per Bonus Entry Period, regardless of method of entry.

DRAWING: A random drawing will be conducted on or about September 20, 2021, among all eligible entries received, by Marden-Kane, Inc., an independent judging organization, whose decisions are final on all matters relating to this Sweepstakes. Odds of winning the Grand Prize depend on the number of eligible donation and mail-in entries received.

PRIZE: One (1) winner will be randomly selected to receive the following: A Super73® Electric Motorbike that comes with a headlight, taillight and an electronics suite that pairs with iOS and Android devices through the new Super73 app, Approximate Retail Value (ARV) is $2,795. PLEASE NOTE: Prize may not meet safety testing required in some states or counties. Winner is responsible to check their state of residence and must use motorbike in accordance with federal/state/county regulations.

PRIZE DETAILS: Grand Prize winner is responsible for any registration fees and any other expenses not listed herein, including but not limited to costs incurred by winner related to acceptance, transport and use of prize and must provide any additional information that is required by the laws of the winner’s state prior to delivery. Winner must agree to pick up prize at a Sponsor-specified location in the U.S. within six (6) weeks of notification of availability from the Sponsor; failure to take delivery within six (6) weeks of availability could cause prize to be forfeited and awarded to an alternate. Grand Prize winner will be responsible for any expenses including but not limited to gas, and any other costs incurred by winner related to the acceptance, transport and use of prize. The prize is awarded “AS IS” and WITHOUT WARRANTY OF ANY KIND, express or implied, (including, without limitation, any implied warranty of merchantability or fitness for a particular purpose). No substitution or transfer of prize permitted except at the sole discretion of the Sponsor. Prize winner is responsible for the payment of all applicable sales and income taxes/duties on their prize. Grand Prize winner will receive a 1099 Tax Form for the value of the prize as stated herein to file with the IRS for the tax year in which the prize is awarded. Sponsor reserves the right to substitute prize of equal or greater value. In the event there is a discrepancy or inconsistency between statements contained in any Sweepstakes-related materials, and terms and conditions stated in the Official Rules, the Official Rules shall prevail, govern and control and the discrepancy will be resolved in Sponsor’s sole and absolute discretion.

GENERAL RULES: Potential winner will be notified by email, followed by a phone call, on or about September 21, 2021. If a potential Prize Winner is deemed a minor in his/her state of residence (residents of Alabama and Nebraska must be 19 years of age or older; residents of Mississippi must be 21 years of age or older; to be age of majority) at the time of entry, his or her respective parent or guardian may be required to execute the Affidavit of Eligibility/Liability/Publicity Release document in order to accept the prize on behalf of the winner. If parent or guardian is unavailable to execute this document, the winner will not receive the prize and will not be entitled to receive any compensation. Potential winner (or parent/legal guardian if winner is considered a minor in his/her jurisdiction of residence) will be required to sign and return an Affidavit of Eligibility/Publicity and Liability Release, (where legal) and a W9 Tax Form within four (4) days of notification attempt or prize will be forfeited and an alternate winner determined at random from among all remaining eligible entries. If the potential winner does not return the required documents within the stated timeframe, the corresponding potential winner will be disqualified and an alternate potential winner will be selected. Should the potential winner decide to decline the prize for any reason whatsoever, Sponsor shall have no further obligation to that potential winner, and an alternate potential Winner will be selected, if time permits. Acceptance of a prize constitutes permission to the Sponsor and its agencies to use winner’s name, photograph, video, likeness/image, voice and/or comments for purposes of advertising and trade without further compensation, unless prohibited by law. By accepting a prize, winner agrees to hold Releasees harmless against any and all claims and liability from any accident, loss or injury occurring from this Sweepstakes or in any way related to the prize or use/misuse thereof, or while traveling to and/or from a location to obtain or use a prize. No substitution or transfer of prize allowed, except at Sponsor’s sole discretion. Releasees shall not be liable for any printing or other errors or for delays in mail service. All entries become the property of Sponsor and will not be acknowledged or returned. By participating in this Sweepstakes, entrants agree to be bound by these Official Rules and the decisions of the Sponsor, which are final and binding. Any questions, comments or complaints regarding the Sweepstakes are to be directed to the Sponsor at the address below.

CAUTION: ANY ATTEMPT BY A PARTICIPANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY ONLINE SERVICE OR WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES 4 THE RIGHT TO SEEK DAMAGES AND/OR OTHER REMEDIES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that or any other provision.

WAIVERS, DISCLAIMERS, RELEASES, INDEMNITY: BY ENTERING THE SWEEPSTAKES, ENTRANT AGREES THAT TO THE EXTENT PERMITTED BY APPLICABLE LAW: (1) ANY AND ALL DISPUTES, CLAIMS, AND CAUSES OF ACTION ARISING OUT OF OR CONNECTED WITH THE SWEEPSTAKES, OR ANY PRIZE AWARDED, WILL BE RESOLVED INDIVIDUALLY, WITHOUT RESORT TO ANY FORM OF CLASS ACTION; (2) ANY AND ALL CLAIMS, JUDGMENTS, AND AWARDS WILL BE LIMITED TO ACTUAL THIRD-PARTY, OUT-OF-POCKET COSTS INCURRED (IF ANY) NOT TO EXCEED FIVE DOLLARS ($5.00), BUT IN NO EVENT WILL ATTORNEYS' FEES BE AWARDED OR RECOVERABLE; (3) UNDER NO CIRCUMSTANCES WILL ANY ENTRANT BE PERMITTED TO OBTAIN ANY AWARD FOR, AND ENTRANT HEREBY KNOWINGLY AND EXPRESSLY WAIVES ALL RIGHTS TO SEEK, PUNITIVE, INCIDENTAL, CONSEQUENTIAL, OR SPECIAL DAMAGES, LOST PROFITS, AND/OR ANY OTHER DAMAGES, OTHER THAN ACTUAL OUT-OF-POCKET EXPENSES NOT TO EXCEED FIVE DOLLARS ($5.00), AND/OR ANY RIGHTS TO HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED; AND (4) ENTRANTS' REMEDIES ARE LIMITED TO A CLAIM FOR MONEY DAMAGES (IF ANY) AND ENTRANT IRREVOCABLY WAIVES ANY RIGHT TO SEEK INJUNCTIVE OR EQUITABLE RELIEF. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY, SO THE ABOVE MAY NOT APPLY TO YOU. EACH PARTICIPANT AGREES (I) TO ABIDE BY THE TERMS OF THESE OFFICIAL RULES AND THE DECISIONS OF THE SWEEPSTAKES ENTITIES WHICH ARE FINAL AND BINDING ON ALL MATTERS RELATING TO THIS SWEEPSTAKES, AND (II) TO RELEASE, DISCHARGE, INDEMNIFY AND HOLD HARMLESS THE RELEASED PARTIES FROM ANY AND ALL CLAIMS OR LIABILITY IN CONNECTION WITH PARTICIPATION IN THIS SWEEPSTAKES OR ACCEPTANCE OR USE OF ANY PRIZE INCLUDING, WITHOUT LIMITATION, ANY ACTIVITY RELATED THERETO.

INTERNET: Releasees and any Internet access or service providers are not responsible for incorrect or inaccurate entry of entry information, human or other error, technical malfunctions, lost/delayed data transmission, omission, interruption, deletion, defect, line failures of any telephone network, computer equipment, software or any combination thereof, inability to access Web sites, or damage to a user's computer system (hardware or software) due to participation in this Sweepstakes. If Sponsor determines, in their sole discretion, that there is any suspected or actual electronic tampering with the Sweepstakes or if technical difficulties compromise the integrity of the Sweepstakes or if any noncompliance with the rules has occurred, Sponsor reserves the right to void the entries at issue and/or terminate the Sweepstakes and conduct a random drawing to award the Prize using all eligible, non-suspect entries received prior to such termination. The Sponsor will not be responsible for acts of God, dangerous weather conditions, acts of terrorism, civil disturbances, work stoppage, epidemic or any other matters beyond the Sponsor's reasonable control (each a “Force Majeure” event) that may cause the cancellation or postponement of the Sweepstakes. If the Sweepstakes is terminated due to tampering or technical difficulties prior to its end date, notice will be posted at https://ecodrive.community. Any attempt to deliberately damage the content or operation of this Sweepstakes is unlawful and subject to legal action by the Sponsor or its agents. Sweepstakes entries will be awarded to the person whose name appears on the online order form or mail-in entry submitted at the time of entry. Any online entries submitted by automated means, or third-party, will be disqualified. Entries will not be valid until received by Sponsor.

CHOICE OF LAW AND JURISDICTION: This Sweepstakes is offered only in the 48 contiguous United States (excluding the States of Alaska and Hawaii), the District of Columbia and is governed by the laws of the State of California. By entering, entrants irrevocably consent to the sole and exclusive jurisdiction of the courts of the State of California located in Orange County for any action, suit or proceeding arising out of or relating to this Sweepstakes. CLAIMS MAY NOT BE RESOLVED THROUGH ANY FORM OF CLASS ACTION.
